The course begins by outlining the Mental Capacity Act 2005 (MCA), explaining the term ‘capacity’ and identifying who is affected by the legislation. The learner is then informed about the five statutory principles of the MCA before learning about good practice in supporting an individual to make decisions. In the next stage, the learner is supported to understand the two-stage test for assessing capacity and informed about who should be involved in the capacity assessment. The course then explains the role of the Mental Capacity Advocate, the Court of Protection and the Lasting Power of Attorney.
